The short version
Towhub is a marketplace. Independent, licensed tow companies quote and perform the tow; Towhub shows you the quotes, holds and collects payment, and lets you track the job. You pay the price you were quoted (plus any extras you approve) only when the job is complete. Towhub is not the tow company and does not drive the truck.
Plain-language summaries like this one are for convenience. The numbered sections below are the agreement.
1. Who we are and what this covers
Towhub ("Towhub", "we", "us") operates the website at towhub.co and related apps (the "Service"). These Terms of Service ("Terms") govern your use of the Service as a visitor, a customer requesting a tow, or a member of an organization that uses Towhub. Tow companies are additionally bound by the Tow Provider Agreement; businesses that order tows on invoice are additionally bound by the Business Account Terms. Our Privacy Policy, Text Messaging Terms and Cancellations, Payments & Refunds policy are part of these Terms.
By using the Service you agree to these Terms. If you don't agree, don't use the Service.
2. What Towhub is — and isn't
- Towhub is a technology platform that connects people who need a vehicle towed or serviced with independent tow companies ("Providers"). Providers are separately owned and operated businesses. They are not employees, agents, partners or contractors of Towhub, and Towhub does not control how they perform a job.
- Providers set their own prices. Quotes you see are computed from the Provider's published rates and the details of your request; Towhub's platform fee is paid by the Provider out of the price and is never added on top of the quote.
- The Provider performs the tow. Towhub does not own trucks, employ drivers, or provide towing, recovery, roadside or storage services. Any claim relating to the performance of a job — damage to a vehicle, delay, conduct of a driver — is between you and the Provider, subject to Section 9.
- Towhub is not an emergency service. If anyone is hurt or in danger, call 911 first.
3. Using the Service
- You must be at least 18 and able to enter a binding contract.
- You may request a tow without an account. To keep receipts and history you can create an account, which links it to the phone number and email you used.
- You're responsible for the accuracy of what you tell us: where the vehicle is, what it is, what happened, and that you're entitled to have it moved. Requesting a tow for a vehicle you don't own or control without authority is a violation of these Terms and may be a crime.
- You agree not to misuse the Service: no false requests, no interfering with other users or Providers, no scraping, reverse engineering, or attempting to access data that isn't yours, and no use that violates any law.
- We may suspend or terminate access for violations, suspected fraud, or to protect the Service, Providers or other users.
4. Quotes, acceptance and price
- A quote is an offer from a Provider to perform the described job at the stated price, valid until it expires (typically 10 minutes; longer for scheduled jobs). Choosing a quote asks the Provider to confirm; the job exists once the Provider accepts.
- Quotes are itemized (for example hook-up, mileage, after-hours, extras, sales tax) and based on the distance we compute between the pickup and destination you gave. If the destination changes, or the situation on scene requires additional services (winching, dollies, a longer route), the Provider may propose extras. Extras require your approval before they are charged.
- Sales tax is collected where required (towing is taxable in Washington) and shown on the quote.
5. Payment
- Card payments are processed by Stripe. Towhub does not store your full card number.
- When you choose a quote we save your card. When the Provider accepts, we place a hold for the quoted amount. The hold is captured only when the job is completed. If the job is cancelled, the hold is released (see the Cancellations policy).
- The Provider is the merchant of record for the tow; Towhub collects payment on the Provider's behalf and remits it, less the platform fee, through Stripe Connect.
- You receive an itemized receipt by text and, if you gave one, by email. Receipts are also available on the tracking link.
5a. Tips
After a job is complete you may tip the driver from the tracking page. Tips are charged to your saved card as a separate payment, passed to the tow company in full with no Towhub fee, and shown on the driver's pay. Tips are optional and non-refundable except in the case of error.
6. Communications
We send text messages about your request and job (quotes ready, driver on the way, receipt). See the Text Messaging Terms for frequency, cost and how to stop. Providers may call the number you gave to coordinate the pickup.
7. Location, photos and tracking
To match you with nearby Providers and let you track the truck, we use the pickup location you enter or share, and Providers' drivers share their location while on a job. Photos you upload are shared with the Provider you choose. See the Privacy Policy.
8. Ratings and content
You may rate a completed job and leave a comment. Ratings must be honest and about your own experience. We may remove content that is abusive, false, or unrelated. You grant Towhub a license to display content you submit in connection with the Service.
9. Disputes, damage and liability
- Provider responsibility. Providers are required to hold the licenses and insurance their jurisdiction requires (in Washington, registration with the State Patrol as a tow truck operator and the required liability, cargo and garage-keepers coverage). Claims for vehicle damage or loss are made against the Provider and its insurance. Towhub will help you contact the Provider and will share job records (times, locations, photos) on request.
- Disputes. If your vehicle was damaged, you were charged more than quoted, or the job wasn't performed as described, open a dispute from the tracking page or receipt within 30 days of the job (or email support@towhub.co). The Provider has 48 hours to respond. We review the job record — status times, driver locations, the crew's condition photos and yours, and both statements — and decide on a full refund, a partial refund, or no refund. Refunds go back to the card you paid with. Our decision resolves the payment question only; it doesn't limit any claim you may have against the Provider or its insurer for damage beyond the amount paid through Towhub.
- Disclaimer. The Service is provided "as is." To the fullest extent permitted by law, Towhub disclaims all warranties, express or implied, including fitness for a particular purpose, and does not guarantee that a Provider will be available, arrive at the estimated time, or perform the job.
- Limitation. To the fullest extent permitted by law, Towhub's total liability for any claim arising from the Service is limited to the greater of the amount you paid through Towhub for the job giving rise to the claim or $100, and Towhub is not liable for indirect, incidental, consequential or punitive damages. Some jurisdictions don't allow these limitations; in those, they apply to the extent permitted.
- Nothing in these Terms limits liability that cannot be limited by law, including for fraud or for death or personal injury caused by negligence.
10. Governing law and disputes with Towhub
These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law rules. Any dispute with Towhub that can't be resolved informally will be brought in the state or federal courts located in King County, Washington, and you consent to their jurisdiction. [DECISION: counsel to advise whether to add an arbitration clause and class-action waiver.]
11. Changes
We may update these Terms. The version date at the top changes when we do. Material changes will be announced on the Service or by email to account holders. Continued use after a change means you accept the new Terms.
